Medical Malpractice Cap

An attempt will be made to raise the $500,000 limitation of liability for medical malpractice to $1 million, supposedly to keep up with the rate of inflation since the inception of the Act in 1975. Advise your legislators that there is currently an effort at the national level to establish a cap lower than $500,000. Emphasize that the law in Louisiana already provides for unlimited future medical payments to assure injured patients are properly treated. Your legislative contacts must emphasize that the Patient’s Compensation Fund is presently underfunded and repeal of the $500,000 limitation of liability would bankrupt the fund.

Remind your legislators of your opposition to raising the cap on medical malpractice liability from $500,000 to either $750,000 (SB 130 by Senator Cox) or $1 million (HB 224 by Rep. Murray).
